STILL CURRENT IN 2026
Key Facts: The USPAP Nondiscrimination Rule
Which edition is current? The 2024 Edition of USPAP, effective January 1, 2024. It has no end date and stays in effect until the Appraisal Standards Board adopts a new edition.
Which part of USPAP requires appraisers to know and comply with fair housing and antidiscrimination laws? The ETHICS RULE, in its Nondiscrimination section.
Which three federal laws does it reference? The Fair Housing Act, the Equal Credit Opportunity Act, and the Civil Rights Act of 1866. Advisory Opinion 40 expands on how these apply to appraisal practice.
Which law is not one of the three? The Real Estate Settlement Procedures Act (RESPA). It governs closing and settlement practices, not appraisal discrimination.
Why did the ASB revise the rule? To make the prohibition on bias and discrimination clearer and more explicit, by removing older language about "supported" and "unsupported" conclusions and directly referencing antidiscrimination law.
Did it create new duties? No. Appraisers already had to follow applicable laws and avoid bias. The 2024 Edition states that obligation more clearly and introduces the concepts of disparate treatment and disparate impact.
